Pedestrian Accidents

Pedestrian accidents may occur in largely populated areas due to people walking and taking public transportation, however, these accidents may occur even in rural areas. At the Brod Law Firm, we have experience in dealing with pedestrian accidents that have resulted in serious injuries and death, that have occurred on busy city streets, as well as on country roads.

Pedestrians can be hit by automobiles, buses, motorcycles, and even bicycles. In the State of California, a driver of a vehicle is required to yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, though a pedestrian must also use due care in these areas (California Vehicle Code Section 21950). As of July 1, 2008, it is illegal to use a hand-held wireless telephone while operating a motor vehicle in the State of California (California Vehicle Code Section 23123). Whether a driver is distracted, or simply not paying close enough attention to the road, it does not take much of a mishap by a driver to cause a serious injury to a person who is on foot, without the protection of thousands of pounds of steel around them. According to the National Highway Traffic Safety Administration's National Center for Statistics and Analysis:

  • 61,000 pedestrians were injured in traffic crashes in 2006.
  • 4,784 pedestrians were killed in traffic crashes in 2006.
  • A pedestrian is killed in a motor vehicle crash every 110
  • A pedestrian is injured every 9 minutes

Depending on the type of accident, pedestrians who are involved in accidents may suffer one or more types of injuries such as neck or back injury, amputations, spinal cord injury, brain injury or even death. A pedestrian who is injured in an accident has the right to file a claim, and the family of a pedestrian who is killed in an accident has the right to file a wrongful death claim.
