Arbitration is a form of "alternative dispute resolution, which is simply another way of resolving disputes outside of the courtroom. In an arbitration, the parties present their cases to an arbitrator, or a panel of arbitrators, and a decision is made as to who wins the dispute. The arbitrator(s) act as the judge and jury in a given case. An arbitration can be "binding", and have the same effect as a decision made by a judge or jury in court, or be "non-binding." In a non-binding arbitration, the parties are not bound to accept the decision(s) of the arbitrator.
